Staying longer on an X2 visa: the extension papers in the immigration service guides

If your X2 stay ends before your short course does, the filing is an application to extend the stay under Article 29 of the Exit and Entry Administration Law. Article 29 requires you to file it seven days before the expiry of the duration specified in your visa. Neither the Law nor the two National Immigration Administration service guides ties the extension to the length of a course.

The rule in Article 29

Article 29 of the Exit and Entry Administration Law (English text published by the National Immigration Administration) sets these steps in this order:

  1. The visa holder files an application with the exit/entry administration of the public security organ in the place of stay, "seven days prior to the expiry of the duration specified in the visa".
  2. The holder submits "information of specific application matters in accordance with relevant requirements".
  3. On examination, if "the reasons for extension are appropriate and sufficient, such extension shall be granted".
  4. If an extension is denied, "the foreigner shall leave China on the expiry of the duration".

The same article sets the cap: "The accumulated length of extension shall not exceed the original duration of stay specified in the visa."

The papers the service guides list

The English service guide, in its section 2 "Documents required for visa extension", says: "To apply for extension of a stay, a foreigner shall apply to the exit and entry departments of public security organs 7 days prior to the expiration date of the stay specified in the visa, and submit relevant supporting materials as required." The Chinese guide of the National Immigration Administration, published on the government service platform, states the same seven-day rule before its own item 10. General materials

The Chinese guide's general list, in its opening paragraph (一), reads: when accepting a visa document application, the office "shall require the applicant to complete the relevant formalities and submit relevant materials". Its items are:

  1. a valid passport or other international travel document;
  2. a completed application form for foreigners' visa documents, and one recent photograph that meets the standard of the exit-entry document photograph guidance;
  3. supporting materials relating to the reason for the application;
  4. other formalities that shall be completed and other supporting materials that shall be submitted.

The X2 extension

The English guide's item j reads: "Holder of X2 visa shall submit a current study certificate issued by an education or training institution within the territory of China. The stay may be extended for no more than 180 days." Its note adds: "The accumulated extension of stay shall not exceed the original duration of stay specified in the visa."

The Chinese guide's item 10 says the holder of an X2 visa "应当提交中国境内教育、培训机构出具的在读证明函件" (in English: shall submit a study certificate of current enrolment issued by an education or training institution in China). Its wording on the period is that the stay "可以延长停留期限不超过180日" (may be extended for no more than 180 days).

The study certificate is the document the education or training institution issues. Item j of the English guide names no course length, and neither X2 passage names a course length.

Changing to an X2

The English guide's item g covers a different procedure from the extension, namely the change to an X2 visa. It reads: "To apply for the change to X2 visa, the applicant shall submit an official letter and a certificate of admission and enrollment issued by an education or training institution within Chinese territory, and may be issued a zero-entry, single-entry or double-entry visa with a validity period of no more than one year and a stay of no more than 180 days."

Item g is the passage for a change of visa type. Item j is the passage for extending the stay of an X2 holder.

Planning note
