Renewing a residence permit for study: the papers and the 30-day window
If your study continues past the expiry date on your residence permit, you apply to extend the permit. Article 32 of the Exit and Entry Administration Law requires the application to be filed "within 30 days prior to the expiry of the validity period on their residence permits", with the exit/entry administration of the public security organ at or above the county level in your place of residence. The papers are set out in the National Immigration Administration's service guide: the general materials, the study-category materials, and the paragraph on extension.
The filing window
Article 32 sets the window as the 30 days before the expiry of the validity period on your residence permit. The article gives no processing time.
As a suggestion, not a rule, find the expiry date printed on your permit and count back 30 days to see when the window opens.
Article 32 also states the test for a decision: "If upon examination, the reasons for extension are appropriate and sufficient, an extension shall be granted."
Where to file
Article 32 names the receiving office as the exit/entry administrations of public security organs under local people's governments at or above the county level.
The English service guide on extension or change says that the applicant "shall submit an application to the exit and entry departments of public security organs under a local people's government at or above the county level in the place of residence 30 days before the expiration of the validity period of the residence permit".
The general papers
The National Immigration Administration's Chinese service guide, paragraph (一), lists the general materials for residence permit applications. The English wording below is this site's translation of that Chinese text.
- A valid passport or other international travel document.
- The foreigner visa and certificate application form, and one photo meeting the standard in the Guidelines for Photographs for Exit and Entry Documents.
- Materials relating to the purpose of the application.
- Other procedures to be completed and materials to be submitted.
Paragraph (一), after item 4, says supporting certificates "may be presented in original, with copies retained". Item 3 refers to materials relating to the purpose of the application without naming them.
The study papers
Section 6.2, item 2 of the Chinese service guide sets the study-category materials. The English below is this site's translation.
- For an entry on an X1 visa: a letter from the school stating the study period, plus proof of admission or enrolment. If these materials are already registered in the national management information system for studying in China (全国来华留学管理信息系统), paper copies may be exempted.
- For an entry on another visa type: the same school materials, and also certification from the competent authority.
- A residence permit "may" be issued with a validity period matching the study period the school states.
Item 2 does not say which of the two entry routes applies to an extension file. Check with the office handling your case which materials it expects.
The extension paragraph
Paragraph (三), headed "Application for extension and replacement of residence permits", applies to foreigners who extend their residence period. In translation, it says the applicant shall submit the relevant certification materials or basic personal information, and the certification for any change of purpose of stay, as required by the provisions above. It adds that the residence period may be extended and a residence permit may be replaced.
The English service guide says: "The residence period may then be extended, and a new residence permit may be issued."
If the extension is denied
Article 32 says: "if an extension is denied, the foreigner concerned shall leave China on the expiry of the validity period specified in their residence permits."
The English service guide words the same point differently: "In case of a denial on extension of the stay duration, the foreigner shall leave China before the expiry of the residence certificate." The two texts do not use the same wording for the departure date, so check the current wording with your office before you plan your departure.
